1. Acceptance of Terms

By accessing or using akashpath.in ("the Service"), you agree to be bound by these terms. If you do not agree, please discontinue use immediately. These terms apply to all visitors, users, and API customers of Akashpath.

2. Service Description

Akashpath is an independently operated, commercially run flight-tracking service covering Indian airspace. The platform aggregates ADS-B and schedule data from third-party sources to provide live and historical flight information. The service is operated by a single individual/sole proprietorship under Indian law.

3. Data Accuracy Disclaimer

Flight data displayed on this platform — including positions, altitudes, speeds, schedules, delays, gate information, and weather overlays — is sourced from third-party data providers and ADS-B telemetry. Akashpath does not guarantee the accuracy, completeness, or timeliness of any data. You must not rely on this data for:

• Safety-of-life or aviation operational decisions
• Legal, regulatory, or compliance purposes
• Financial transactions or travel bookings
• Any purpose requiring certified aviation data

Data may be delayed, inaccurate, or missing. Always verify with the relevant airline or airport authority.

4. Pricing, Billing & Refunds

All displayed prices are in Indian Rupees (₹) and are exclusive of applicable GST unless stated otherwise. Promotional/launch pricing is offered for a limited time and may be withdrawn without notice. Subscriptions are billed monthly and renew automatically unless cancelled. All purchases are non-refundable except where required by applicable Indian consumer law. Pricing may change at any time; existing subscribers will receive at least 30 days' prior notice of increases.

5. API Fair Use Policy

API access is granted under a named licence key tied to a specific plan. The following are strictly prohibited:

• Key sharing — one licence key per organisation/project
• Reselling or redistributing raw API data to third parties
• Automated scraping beyond the rate limits of your subscribed plan
• Use in applications competing directly with Akashpath
• Caching data beyond 24 hours for public redistribution

Violations may result in immediate revocation of the API key without refund. Rate limits are enforced server-side; repeated limit breaches may result in permanent suspension.

6. Service Availability & SLA

Akashpath is operated by a single individual on a best-effort basis. No formal uptime SLA is provided for Free or membership plans. API plans (Gold and Platinum) include a best-effort target of 99% monthly availability, excluding scheduled maintenance, third-party data outages, and force majeure events. Planned maintenance will be communicated via email with at least 4 hours' notice where feasible. Downtime credits are not offered.

7. Prohibited Uses

You may not use this service to:

• Conduct surveillance, stalking, or tracking of individuals
• Build automated tools for competitive intelligence against airlines or airports
• Interfere with or overload the platform's infrastructure
• Circumvent access controls, rate limits, or paywalls
• Violate any applicable law, including India's IT Act 2000 and its amendments

8. Intellectual Property

The Akashpath name, logo, website design, and original software code are the intellectual property of the operator. Third-party data (flight schedules, airport information, weather) remains the property of the respective providers. You may not copy, reproduce, or create derivative works from Akashpath's proprietary content without written permission.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Akashpath and its operator shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from: (a) use or inability to use the service; (b) inaccurate or missing flight data; (c) service interruptions; or (d) any decisions made based on information provided by this platform. Aggregate liability shall not exceed the amount paid by you in the 30 days preceding the claim.

10. Privacy & Data

Usage data, cookies, and analytics (Google Analytics) are collected subject to your cookie consent. Email addresses provided for membership or API enquiries are used solely for communication regarding your account/subscription and are never sold. Data retention follows applicable Indian law.

11. Governing Law & Disputes

These terms are governed by the laws of India. Any dispute arising from or in connection with these terms shall first be attempted to be resolved amicably by contacting the operator. If unresolved within 30 days, disputes shall be subject to the exclusive jurisdiction of courts in India.
